1. Scope
These Terms of Service ("Terms") govern your access to and use of the festina.ai website and the Festina.ai platform (together, the "Service") provided by Festina Technology d.o.o. ("Festina", "we", "us"). By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you represent that you are authorised to accept these Terms on its behalf.
2. The Service
Festina.ai is an enterprise AI knowledge platform that connects to your organisation's data sources and provides semantic search, AI-generated answers with source citations, document analysis, drafting and related capabilities. Features may evolve over time; material changes will be communicated to customers.
3. Accounts and acceptable use
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You will use the Service only in compliance with applicable law and these Terms.
- You will not attempt to reverse engineer the Service, probe its security, access data you are not authorised to access, or use the Service to infringe third-party rights.
- You will not use the Service to process unlawful content or content you have no right to process.
4. Customer content
You retain all rights to the documents, data and content you connect to or upload into the Service ("Customer Content"). You grant us only the limited right to process Customer Content to provide the Service to you. We do not use Customer Content to train public AI models, and we do not access it except as needed to operate, secure and support the Service, or as required by law.
5. AI-generated output
Answers and content generated by the Service are based on your connected sources and are provided with citations wherever possible. You are responsible for reviewing AI-generated output before relying on it or acting upon it. The Service is a tool that supports — not replaces — professional judgement.
6. Intellectual property
The Service, including its software, design, branding and documentation, is the property of Festina and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. No other rights are granted.
7. Subscriptions and payment
Paid plans, pricing and billing terms are agreed individually per customer (e.g. in an order form or separate agreement). Unless otherwise agreed, subscriptions renew for successive periods and fees are non-refundable except as required by law.
8. Confidentiality and data protection
Each party will protect the other's confidential information with at least the same care it uses for its own. Personal data is processed as described in our Privacy Policy; where we process personal data on your behalf, a Data Processing Agreement applies.
9. Warranties and liability
We provide the Service with professional care and aim for high availability, but the Service is provided "as is" without warranties of any kind beyond those required by law. To the maximum extent permitted by applicable law, our aggregate liability arising from the Service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect or consequential damages.
10. Term and termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, with notice where practicable. Upon termination, your right to use the Service ends and we will delete or return Customer Content as agreed, subject to legal retention requirements.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of Croatia. The courts in Pazin, Croatia shall have exclusive jurisdiction over disputes arising from these Terms, unless mandatory law provides otherwise.
12. Changes
We may update these Terms from time to time. The current version is always available on this page; material changes will be communicated to registered users in advance.
